He obviously can't get "into the system" without filing a tax return. Therefore he needs to do so. He can either file just for the current year, or he can file for the current year and some back years as well. Of course, that would trigger a pretty hefty tax bite....as well as some penalties and interest.

Yes, there will be some risk...however that risk will always exist and only will become greater as he gets older.
