Michigan
This all happened in Michigan. I'm a light to medium substance user. My drug of choice is Opiates. I have no drug charges on my record. I have no association with any drugs or drug related charges. I had no felonies. My biggest crime was retail fraud approximately 7 years ago. I got mixed up with the wrong people and got dependent on Opiates. I know you probably don't care why I started using. Just don't judge me. I don't recall the month or the date. I was broke and starting to experience Opiate withdrawal. I called my dealer. I explained to her my situation. I didn't have much of anything of value at that time, except a 40$ Dollar General gift card. She said that she would take the gift card. However, she was out of town for the night.If I wanted to buy it, I would have to drive 45 minutes into a neighboring county where she was. So I did. I drove 45 mins and called her as I was entering the city.She instructed me to go wait at a "big box convenient store" and wait in the parking lot. It was probably around 10:45 PM. She arrived. She reaches into my window and covertly drops a little .2 of a powered substance in a baggy on my lap and I openly handed her a gift card with the ajouning receipt. She gets in her car and drives away and I drive further into the parking lot, I find a secluded place and I proceed to snort a line. (Like I said, I was getting dope sick). It's was just me and my fiance in the car. As she was about to snort her line and I tell her to be careful, And that there was a state trooper driving somewhere behind us. I saw the reflection in the mirrior. Everything happened so fast. We were surrounded on all sides. 2 or 3 un-marked cop cars and 2 or 3 marked state troopers. At gun point, screaming at us to put our hands up. I didn't even try to stash anything. By the way it all went down I assumed that the dealer was setting me up. I have never been in a situation like that before so I was genuinely in a state of shock. The cops pull us out of the vehicle. Informed us that they were actually surveiling the drug dealer and witnessed the hand to hand take place. They knew the drug dealer by name already. And basically said I was in the wrong place at the wrong time. A search of my vehicle only produced a very small amount of heroin. The main enforcement officer in charge said it was a good thing that he's never heard of me. And asked me some basic questions about my interaction with the drug dealer and he took notes. Just things like "how did you pay for the Heroin you bought from blah blah blah today?, at which point I would respond "I gave blah blah blah a $40.00 Dollar General gift card" And without ever putting me into a cop car he told the other officers that I have been really cooperative and there's no reason to arrest me and mess up my employment for such a small amount narcotics. He said that he would call me the next day to talk about the case and that if I didn't answer, okay. So he let me go and gave me his "narcotics agent credentials" card.The next day comes by and he doesn't call me. I waited 3 days and started to worry, I didn't want a felony warrant of possession to randomly appear out of the blue because this guy didn't get a hold of me. So I call him. He told me he was really busy and could only talk for a second. He asks me about information I have about possible drug dealers in his county. I wasn't from that county and I honestly didn't know anyone from that county, and I informed him of this. I don't think he realized I wasn't from that county up until that point. So I told him, I told him where I'm was from, he said he was familiar with the area. For the next few weeks. I would text him periodically as to avoid a arrest warrant. He would tell me he will message or call at a later date. And eventually communication stopped. I wanted to get sober and I was tired of being a slave every single day to a substance. So in my mind. Moving to another state was the solution to that problem. (Moving solves nothing, not until you're ready to get better) So me and my fiance packed up and moved to Dallas Texas. I kinda forget about the whole ordeal for awhile until one day I get a anonymous text message to my phone. The texter identifies themselves as a narcotics officer as-well. Not from the city where the crime had taken place. He was a narcotics agent from my home town. He inquires about meeting up in person. I informed him that I had moved to Texas. He tells me that he wants to go over some of the previous information they had previously recorded about the events of that night. He asks me about the statements I gave to the other narcotics agent. I confirm and or elaborate on the answered I had provided. The officer says that I have answered all his questions satisfactory, that he's gonna go talk to the prosecutor about getting the incident thrown out since it was such a small amount and I was being cooperative as much as I could be. I was feeling relieved that this is all over and I can breathe freely again. He never calls me back and I never call him back either. Me and my fiance start to grow home sick so we decide it's best to head back towards our home state of Michigan. On our way to Michigan we experience a automotive disaster that leaves us stranded in Lexington Kentucky. We were sleeping in various parking lots in Lexington, as a means of survival. As you probably guessed it? It didn't take long for us to fall on the radar of local police. Officers doing a night patrol around Lexington discover us sleeping in our car in a local parking lot. Which warrants a traffic stop. Well during this traffic stop he informed me that I have a felony warrant out of Michigan on a possession of a controlled substance. Extraditable by states surrounding Michigan. They informed me that I was outside of the extradition range and thankfully let me go.
And now I'm so mad. My record is destroyed. Every traffic stop from here on out is gonna result in a cavity search. It's BS. The county that issued the arrest warrant, isn't even the county where the crime occured. How is that even possible? Do you guys have any legal advice that can help me?
