So my wife's boss asked her "where did you immigrate from" is this legal? She feels like he was trying to put her down.

Also is it legal to audio record customers without their knowledge?

We got a new regional at work and he's very unprofessional

It's not illegal to ask the question. However, it isn't a good idea for a business manager (or owner) to do. If the manager fires her or takes other adverse action against her, that kind of question can be used as a part of building a case against the employer that she was illegally discriminated against under federal law (assuming the employer has 15+ employees). Florida's own employment discrimination laws are pretty weak, so the question might not be much of a problem under state law. If your wife experiences some kind of adverse action she should probably consult an attorney who litigates illegal employment discrimination cases for advice, and do it quickly because under federal law she'd first have to file a complaint with the federal Equal Employment Opportunity Commission (EEOC) within as little as 180 days of the adverse action before she could sue the the employer.

Sometimes a question that is asked is simply asked out of curiosity and there is no ulterior motive behind it. Before your wife thinks about filing any complaint, she might want to make sure the question posed by her boss was not asked in all innocence, with a genuine interest in learning more about your wife.

The company needs to provide HR training for the “Boss” to protect itself.
