2 union questions from california

What is the name of your state (only U.S. law)? california
hi, i have two questions regarding union issues.
1. if our contract ended june 30, 2008, does the employer have the right to uphold certain things in the previous contract? in the old contract, there is a 70% issue that states we have to work 70% of average hours or be suspended for a period of time. to date, we still do not have another contract.
2. if we feel our union is not representing us, who can we go to outside of the union for help?
