contract interpretation


What is the name of your state (only U.S. law)? Michigan

I work for a county office in Michigan. In January my hours were reduced from full-time to part-time. My contract states that "No temporary employee shall be hired if such hiring will result in the reduction of the hours of work of any regular employee." In March, a temporary, part-time person was hired by my supervisor. This employee has been instructed to perform some work that was previously perfomed by me, but couldn't do because I don't have the time now. Is this a breach of our contract? Thanks

It might not be. The contract seems to be saying if the reduction in hours is caused by the hiring of a temp, that's not OK. In your case, the reduction hours occurred several months before the temp was hired - so the reduction had nothing to do with the temp's arrival.

However, this is complicated by the temp now doing some of your old duties. I reco you ask your union rep to clarify this for you.
