I have a question regarding how to interpret a section of a labor contract. The section in question requires the employer "consider items A, B, C, and D when making a decision".
The employer admits that they only considered item A when making a decision but state that the contract does not specify that all the items (A, B, C, D) be considered.
I think that by stating "A, B, C, and D" the contract requires all four items to be considered. If the intent of the contract was that only one item had to be considered then I think it would have read "A, B, C, or D" instead of "A, B, C and D".
Is there any generally accepted guide for writing contracts that would support my interpretation?What is the name of your state (only U.S. law)? |
