in discrimination by a union, what subsection for NLRB form 508?


What is the name of your state (only U.S. law)? New York

Two questions:

(1) I believe my union leadership has discriminated against me by revealing my salary information but not other union members' salary information at a recent union meeting. I was a candidate for office and lost, the victor had promised to reveal my salary during the campaign. I have NLRB form 508 for filing a charge against my union leadership -- in part h the form asks one to list which subsection(s) of section 8(b) of the National Labor Relations Act form the basis for the complaint.

I've read through section 8(b) of the NLRA and am not sure which subsection(s) is/are most appropriate for this type of alleged discrimination (intentional harm to a member) by union leadership. What do you think?

(2) Separately, the union president is declining to file a grievance on my behalf with regards to a wage dispute with my employer, and I feel there is a failure to represent. Again for completing form 508, what subsection(s) is/are most appropriate to list for an allegation against a union for failure to represent in a grievance against an employer related to wages?

I am not positive but after exhaustive research, I believe I may have found an answer for failure to represent:

8(b)(1)(a)


Not sure about the disclosure of your salary. Actually, not sure it is a violation of the NLRA especially since it has nothing to do with your employment.

I would think that would be something more likely within your union bylaws. Something such as conduct unbecoming of a union member or something of the sort.
