labor issue


What is the name of your state (only U.S. law)? Ca. I have been a campus police officer for 10yrs. 5 as a classified employee. In Oct. of 2008 I was forced to submit to a psy. eval. because they did not do it when I was hired. I also had to submit to another background investigation a turn in a credit report at my own expense. I was told I did not pass the psy. eval. but never told why. They used the findings to demote me to a security officer a position that we dont have on the campus. To this point the Union has done nothing to fix this problem. I have never had a bad job evaluation nor have I ever been written up. Can I sue my Union? they did nothing to protect my rights or my contract.

A lot depends on how your union contract is worded and I doubt any visitors to this site have a copy. Also, it is very possible that the evaluation is considered a pre-employment requirement and your union has no authority to challenge these types of evaluations. At a minimum, talk to a local attorney familar with labor law.
