osha regulation


What is the name of your state (only U.S. law)? texas

I wanted to know can i sue my employer for violating Osha regulations?

**A: yes, in certain instances and if you are not part of a union or collection bargaining group where arbitration may be required.

well my employer dose not provide us with the proper tool to due or jobs such as, test strip for testing gas or desile instead they ask us to sniff it and or proper credential that's needed in case the coastguard needs to see them

Usually OSHA has their own investigators if the company is at fault they will fine them. Individual employees are covered under OSHA whistelblower statutes.

well, that is at least some explanation.

As to suing them for not providing the test strips, if they are legally required;

I do not believe this would be such a situation that would allow it. Requiring you to "sniff" the fuels, in my opinion, would be easily remedied by simply saying "no" or claiming lack of ability to be able to discern the two fuels anymore due to the desensitization you have experienced due to the continued exposure to the fuels.

I am wondering what venue this is in. Are you military?

Seriously slic, you have to stop sniffing the cans. Either tell the boss to get proper detection devices or materials of make up an excuse as to not being able to discern the difference or just tell him no. At this point, it is up to you to stop performing actions that put your health in jeopardy.
