Reassignment and union contractWhat is the name of your state (only U.S. law)? MA Iput in a bid and in August it was pulled for a core position. I was told at that time that the job would start in September. I received letter for reassignment in September with my new hours and a start date. HR called the day I got letter saying I didn't get position--person with more seniority got it. I was told that person had spoken with director and they had seniority so they got position. Union contract says bids must be in prior to vacant position. My union says I don't have a grievance because seniority is the deciding factor. Is this correct and is there a binding contract between union and union member? What is the name of your state (only U.S. law)? |

| Without reading your union contract, it is virtually impossible to answer your question. In my union a position is considered vacant till the day one starts the new job, not when it is offered. If your union contract is the same, your union is correct.
