Tape recording conversations


What is the name of your state? Indiana


I am a supervisor for a company in Indiana, and I have been falsely accused of foul language in conversations with union employees. Is it legal for me to carry a voice recorder to capture my conversations to disprove this?

As long as the others being recorded are aware of it.

Ind. Code Ann. § 35-33.5-1-5: The recording or acquiring of the contents of a telephonic or telegraphic communication by someone who is neither the sender nor the receiver is a felony and can be the basis for civil liability. Ind. Code Ann. §§ 35-33.5-5-4, -5.

Which I interpret to mean that Indiana is a "one party" consent State. But what is tape recording conversations going to prove? That you stopped using foul language once you started taping yourself and others? This could also get you in big trouble with your management. I think it's highly likely they'd have a big problem with any employee tape recording conversations at work without their knowledge and express consent.

This is not a good plan and will not serve any useful purpose.
