Are the booking photos(mug-shots)of felony cases considered private or public record? or other?

I have read and been told, Felony records are considered public record. I in fact I have obtained photo-copies of "Case Action Summary" from the County Courthouse.
However, when I asked for a photo-copy of the booking photo(mug-shot) I was told that is considered private info.
The case in question is a 1991-92 felony case in Montgomery, Ala in which the defendant pled guilty, served two years supervised probation.
