foreign citizen & constitution?


What is the name of your state? TEXAS.

Hi, I hope I'm posting this in the right place. It seemed to make sense. I am a graduate student studying library science. My current assignment is to write a position paper on the Patriot Act. The premise is that a sniper is suspected of using my library. The suspect is a foreign citizen. My question is: does the 1st. amendment apply to this person? My instinct says no, since he is not American. Any thoughts and comments would be appreciated.

I'm not asking anyone to do my homework for me. I am more than willing to write the 15 page paper by meself. I just wanted an opinion. If you do not want to offer an opinion in a respectful manner, then I don't want yours.

This is a difficult question to answer. The correct anwser has always been the constitution protects everyone citizen or not. However removing this protections is exactly what that contemptible little president of ours did when he suspended habeas corpus under the patriot act (see quote) I believe the case is still in the courts. The phrase "awaiting such determination" is stunning. That means anyone can be held indefinitely and without benefit of counsel.

"No court, justice, or judge shall have jurisdiction to hear or consider an application for a writ of habeas corpus filed by or on behalf of an alien detained by the United States who has been determined by the United States to have been properly detained as an enemy combatant or is awaiting such determination."
