1. 2 people summoned before court by D.A. for contempt of child support......1 2 months behind, the other 7 months. Both were found guilty...in willful contempt although judge acknowledged man 2 months behind had valid reasons...but still behind...still guilty because man did not notify court of $ problems himself. Both were handed a bill for $90 dollars for D.A. services to prosecute, due in 30 days or warrant for arrest issued. One man has tried to negotiate with D.A. more time,refused. N.C. law states cs monies/obligations due/payable before any other financial obligations owed. Man 1 was arrested at his job 31 days after court for failure to pay D.A.. Cost to leave jail now $90 fee plus $175 for sherriff services,etc... Is this not enforcing a law,punishment that prevents one from complying with a law/court order? Paying the D.A. first would cause the cs payor to be in contempt of the cs order....now the $ is more than doubled...all that could go to paying off the behind support...how does this work?

The law is AMAZINGLY straight forward in these cases. Child Support obligations COME FIRST - before bills, before gas for your car (even to get to work), before EVERYTHING. The law doesn't cause the contempt, the one who doesn't pay child support causes the contempt. Courts have very little tolerance for those who don't pay child support.

The point is not the fault of the contempt....the point/question is that if cs comes first...why is the D.A.'s legal fee coming and expected to be paid before the owed cs? If the state is so concerned with cs and it's benefit to the children, why is the debt to the state coming before the cs obligation and then to prosecute the cs payor for not paying the state only prevents the cs payor from being able to meet the cs obligation, so where did all the concern for the child's benefit go? Basically the state is saying that the state's financial benefits come before any child's.
