Congress makes it a felony for any individual to place a bet with another individual on a sports event, or to propose such a bet. The statute is writen broadly, so as to cover two friends who bet with eachother primarily for the purpose of friendship rather than profit. The House and Senate Committee Reports on the bill show that Congress believed that ostensibly "friendly" betting creates a climate that is tolerant of gambling, which in turn increases the interstate gambling profits of organized crime, a multi-million dollar nationwide problem. Donald is charged with violating the statute by placing a bet on the Super Bowl with his best friend, Elaine. They made the bet face to face within a single state. Donald defends himself on the grounds this statute is unconstitutional. Will he succeed? Explain your answer.

Forget it. I was going to at least read your question since, most people who want help with their homework are at least upfront enough to have done some work on their own and need only to understand a point or two.

But bringing the entire question here without a modicum of effort and to expect this board to do your work for you is just plain stupid.

Please tell me you are thinking of practicing law in California. At least then it might explain your behavior. :rolleyes:

Were you paying attention in Con. Law? Or did you choose to snooze and are now paying the price?

Hint this is a commerce clause question. Beyond that, you better bury that nose of yours in the books and figure out whats going on.

Yes, that's about the only way Congress would have the power to act. So much of the facts the poster posted though is totally irrelvent.

Who cares? The question is does Congress have the right to adopt the law, not a debate over whether it's a good policy.
