What is the name of your state (only U.S. law)? south carolina. it looks to me like transmutation of property from non marital to marital is a violation of the constitution. things used to determine transmutation are subjective. for example, did you treat the property you owned before the marriage as marital. iis transmutation of property unconstitutional????

The word transmutation does not appear in the Constitution or any of it's amendments.

Your post seems to imply that you think that if something is subjective, it's unconstitutional. Am I reading your post correctly, and if so, where did you get that idea?

... if you co-mingled the separate property with marital property, then the separate property may have become community property.
In some circumstances, you can 'trace' separate property and argue that it should remain separate property.
Many states' laws differ on property designation and division. Check your State's Family Code.
