Hello FA,

So....I've recently been audited for hours which i took off that were paid, but should have been unpaid. This audit goes all the way back to February. As a result, with Christmas right around the corner, im looking at a 58% cut in my next check.

My question is, is there any legalities that may hold large businesses accountable for the time they pay their employees? I also have a chunk of vacation time that I am not allowed to use to cover the discrepencies.

Basically, im wondering if there is a way I can avoid this massive paycut during the holidays.

You can refuse to have this overpayment deducted from future pays. However, your employer will be legally free to fire you and/or sue you for the amount owed.

Otherwise, you don't have any legal recourse. You can try to negotiate a better repayment plan with your employer, but your employer is legally free to refuse to enter into any such plan. All your employer is legally required to do is pay you at least minimum wage until the overpayment is recouped.

Your employer is not legally required to use your paid vacation time the way you'd like it to be used.

Why didn't you nip this in the bud when you first realized you were being paid for time you didn't work?
