Boss wont pay!


What is the name of your state (only U.S. law)?
Massachusettes

Ok last week my boss told me that he would like me to attend an ASM meeting with him, it was the first time I've been invited to attend one. I was told that it would be some sort of training also but when it began it became clear that it wasn't training, just discussions in changes to procedures. Ok to make a long story short the meeting took place after my shift ended at a restaurant and it lasted for 3.5 hours. Today I found out that my employer will not pay me for those 3.5 hours because "it is not something that they pay for", is that even legal? I told my boss that if I don't get paid we will settle it in court and he basically let me know that if I do persue it down that route, I can easily be replaced. What can I do In a situation like this, I am so sick and tired of this place abusing their power with the employees.

ohh and something else that I found completely strange is that someone clocked me out at 4pm, that day I did not punch out due to the fact that I was going to a meeting and if I would've punched out it would have been at 5pm which was the time that I left the building for the meeting.

Describes how non-exempt employees must be paid for training if its outside "normal working hours" - and it was truly "voluntary". If mandatory - it must be paid.

Is your employer subject to the FLSA?

In this economy - I wouldn't be caught dead suing my boss over what - $50?
