CA - W2 Hourly??What is the name of your state (only U.S. law)? CA Posting for a friend. Friend is a W2 for an employer based in CA. The interesting aspect is that he gets paid hourly. His employer deducts the employer portion of social security and medicare from hios gross wages? The question is can the company legally do this since he is a W2? Are employers not supposed to pay this oit of their pocket and not out of the employee's? |

| How do you know it's the employer's portion of the taxes? Employees also pay a portion of each and this is what is generally shown of an employees pay stub. If your friend feels the employer portion of the taxes are being deducted from his/her paycheck, this person needs to contact your state's Department of Labor and file a complaint.
