Can I sue my employer for lying to me?

I am on H1 visa and my employer had files for my PERM in Nov '08. My PERM was denied by USCIS in Aug '09. However, my employer had been communicating the false information to me (saying that my PERM was in process) till Jan '10. It was only after repeated requests that I was informed in Jan '10 by my employer that my PERM was denied. I wan't to sue my employer for communicating the false information to me for 5 months thus affecting my career and mental peace. Please let me know if I can sue my employer now?

Isn't it ultimately your responsibly to ensure the status of these applications? The DOL does have phone numbers. You were pretty foolish to trust your employer without verifying on your own.
