I was just fired from a sales job with a local company. I worked for them for less then 2 months. They are refusing to pay me my final salary with the argument that the draw that they have been paying is a loan. My understanding is that a draw is against commissions, not salary. My original draw payback period was to be 10 months. Is is legal for them to withhold my final salary as repayment of the draw (loan)?
