Hello. I work at a large casino in New Orleans. I get paid bi-weekly, every other Thursday, direct deposit is mandatory. The week goes from Fri-Thur. The majority of my wages earned are tips, plus I get a small hourly wage (less than min. wage). Every day at the end of my shift the cashier counts my tips and gives me a receipt. All the tips in a 2-week work period are counted up along with the negligible hourly wage and disbursed as a direct deposit. This is my question: If I start work on the last Thursday in a pay period at, say, 7PM and I go off shift at, say 2AM, my workplace will pay me the hourly wage I earned for that Thursday but any tips I earned are held back until the NEXT pay period's check/direct deposit. From what I've been told the last pick-up of the tip receipts is done around midnight so if you are unlucky enough to have cashed out after then you won't see your money for another three weeks. Is this legal? I would think that if you started work on the last day of the pay period they would have to pay you for that...not just hourly, but tips too.. Thanks for the consideration.
