employee vs sub contract


What is the name of your state (only U.S. law)? florida

The company I work for tells me I'm sub contracted but treats me like an employee. Having to pay my own SS each year is painful although I have write-offs that employees don't have.

By the IRS definition I believe I'm an employee (I have a schedule, provided tools, dress code, specific guidelines in the performance of my job).

Is this something I should care about or am I getting the better deal and just don't know it?

I would care about it if I were you. Why should you have to pay both portions of SS/Medicare, not be eligible for UI or Work Comp, not get other benefits such as vacation, sick, insurance, etc?

If you care about these things, contact the IRS and the federal DOL.

I guess I'm trying to determine if I 'should' care. Being a small company there are no benefits (vacation, insurance, sick pay, etc) for the staff that truly are employees.

You really want to pay all that extra money to the government? REALLY? Come on, times are hard, no one has extra to throw at taxes do they?

Plus, it's illegal.
