entitled to unemployment benefitsWhat is the name of your state (only U.S. law)? CA Hello, I am named as one of an owner to a company that we started in 2006. It was very slow due the economy. Therefore, I obtained a job from 2009 - Oct 30 2010. It is a completely different industry than the company I am listed as one of the owners. It is closely related to my professional background. Am I entitled to unemployment benefits. My employer paid my unemployment being an employee of theirs Please let me know if I am entitled to collect under California Unemployment even though I am named as a owner to a company. |

| You are not entitled to unemployment. You may be qualified depending on the reason you are no longer employed and that decision will be up to the State of California.

| I was let go from my job because of the economy. I did their marketing and sales and no accounts were coming from my efforts. The company I am listed has nothing to do with my job where I was laid off from |

| Why are you even bringing this company up (you as an owner) for? Has Calif. said you are not qualified because of it?

| it's 2 different companies. Separate of one another. My employer paid taxes on behalf of me being an employee to them. That is why I am asking if I am entitled to unemployment benifits |

| Yes, it's pretty dumb to be sitting here asking someone like us if you qualify for benefits, when it costs nothing to certify and get your answer from someone who will be able to officially either sign you up or tell you why you don't qualify. There's no downside to filing immediately, even if they were to tell you no. My answer is that it doesn't make a whole whale of a lot of difference if you are listed as the owner on another company other than the one you were laid off from. What will make the difference is are you working for that company and making income from that company at present. If so, and you are making more than the weekly benefit you could draw, then you won't be eligible for unemployment benefits from the company that has laid you off. But if you aren't making any money at the company you are owner of, and you are available to the same extend you were before you are laid off from the other company, you could be eligible to draw, I see no problem. But of course, I'm not the unemployment system in CA, which is who you need to be talking to, right away! |

| Thank you for your response. I was not listed as an owner from the company I was laid off from. The company that I am listed as an owner: I do not work for that company, nor do I make any income from it. I had invested in it years ago, and due to the economy, the company had not been profitable. I decided to work for another company (the company I was laid off from) because the company I am listed as an owner did not make any money. I worked full time with the company I was laid off from. I did not receive any paychecks (income) from the company I am listed as an owner at present (for the past 2 years plus.) |
