free daysWhat is the name of your state (only U.S. law)? American Samoa I have worked for this company for over a year, I came out to an Interview and was engaged and relocated to the Islands on a Labour Contract, Not durring the Interview or in any correspondence or in the contract was or is there any reference to Free Weekend Overtime Days, however after the first 4 to 6 weeks I was informed of this condition, The First 2 Weekend Days of the month that are worked are called Freedays, all other weekend days worked is Overtime and is paid at a fixed OT rate of approx 1.36 x base rate. I have gone with the flow and allowed the freedays to be deducted up until now, however I now Know my value and wish to be honoured to my contract how do I do this ? ? is this practice of telling people they must work these 2 freedays of Weekends legal ? ? freedaysthis is a Big Private Company, and my duties are as an Engineering Supervisor in charge of shift maintenance and installation, the contract is reasonably clear as to the Quantity of Hours per Week and that some Overtime would be necessary and paid at the set rate. your answer will be appreciated thanks, |

| As an (presumed) exempt employee, you are not legally entitled to any additional compensation under the FLSA for "extra hours" or overtime. If your contract with the employer calls for overtime pay, and the conditions under which it will be paid, that is a contract issue, not a wage and hour issue. See an attorney.
