Hourly Wage DeterminationWhat is the name of your state (only U.S. law)? Texas How is hourly wage determined when you are employed as an at will employee who is paid a set amount in a school district? My wages are are spread out by district choice over 12 months but they say that the hourly wage is determined by dividing the amount by 187 days of being in school. When one divides using the 12 month system, it is less than minimum wage and when divides using their method, it is just barely meets the minimum requirement. Which method is correct? |

| The one where it only counts the days where you are actually working.

| Are you exempt or nonexempt? If you are exempt, MW is a non-issue anyway. And do you work in the classroom or administration? It is rare in the extreme for non-classroom workers to be paid over 12 months if they don't work the 12 months.
