Mandating break and automatically docking payMichigan - Is it legal for an employer to mandate a 10 min break during a 4 hour work shift, and will dock pay even if this time is not used? |

| It is legal in ALL states for an employer to mandate breaks, no matter how short (or long) the shift. What's more, in ALL states you can be fired for not taking the break if your employer wants you to take it. However, in no state is is legal to dock pay for a break that was not taken. Also, under Federal law, a break of under 20 minutes must be a paid break. So it is legal to mandate the break, but not legal to dock for it. |
