Indiana- I was a massage therapist at a casino, but not employed at the casino only badged as a vendor. Our boss is a pro poker player who started this "company" where he hired us girls, charged us from $15 to $25/hr to massage poker players, and we charged $2/min and kept the rest. So I worked 6 hrs, the money would be taken right out of my bank account, usually $150. So after about 15 months of this, the business went WAY down and most girls were not even making his "rent" and the money just kept coming out of our banks. I know we signed contracts, but after approaching him a couple of times and trying to think of new ways to get people in the poker room interested in massage again, I suggested that he, at least temporarily lower rent, and she shot it all down so I quit. All sounds legal, just horrible. Of course there is SO much more to this story, but yeah, he sucks and I just think it SHOULD be illegal to charge someone more than they make. No minimum wage, no pay at all, just what we made ourselves. Another thing I don't really understand, if we were technically "self employed" and "vendors" what right does he have to charge us anything?

And BTW, no way are you a massage therapist! You have just insulted the massage therapy profession as a whole by insinuating that you are a member of that profession. A massage therapist is someone who is professionally trained and licensed to provide therapeutic massages of a medical nature to patients. At best you are a masseuse.

I am so so sad! Yes I did post this thread last week and didn't get any response so I did repost it. Also, yes I am a massage therapist. I went to school, six years ago, got a REAL certificate and everything! Licensed, insured, certified the whole nine yards. Then I got married and had kids and just did massages as a part time job, thats when I heard about the massage business opening up in the casino by my house, and I got the job along with about 15 other girls, all certified licensed and insured. Just so you know, this makes us legitimate massage therapists! This is no joke, everything I posted was real and I am just in search of some answers as far as if it is legal to charge employees more than they make, per shift just like I posted. I know we signed a contract and I know that the whole thing stinks of "pimp" like status, but again, I assure you, we were all signed as independent contractors, but yet we still paid this guy, thats where I need legal advice not snarky remarks as to my training. I am a real person, a mother of two and a wife who just lost my job right before Christmas and yes I am mad, I'm mad as HELL at the fact that this guy made some big promises that we would be able to go out into the whole casino and massage, but the truth is we were never allowed to leave the poker room. And he assured us that the nights where we didn't make "rent" would be very few and far between, and that was also a lie. We were also told we could work every tournament, but yet there are constantly big tournaments like celebrity ones and hockey and football ones and we were never allowed to go up there to massage. I know it sounds like I was just lied to so suck it up, but to me there should be something illegal about what he did.

Just because something seems to you that it should be illegal doesn't mean that it is illegal.

Based on the information that you've provided, it doesn't seem that your pimp has done/is doing anything illegal. However, he is still required to adhere to the terms of the written contract he signed with you. If he is, then fine, you don't have any legal issues. If he isn't, then you may sue him for breach of contract.

eerelations- um . . . thanks I guess for being the only one who responded. I am not stupid as your tone seems to suggest, or maybe you think I'm like 2 years old. I know just because it should be illegal doesn't mean it is. That is why I tried this site to see if anyone who knows anything about employment law could find something illegal about what my boss is doing. I've read some other threads on this site, and well lets say that this isn't a bunch of friendly helpful people trying to give out some good advice, its more like a bunch of "I'm better than you" pretentious know-it-alls trying to make people feel bad for even asking a question. I know freedom of speech blah blah blah, but maybe admisitrators will see that a site like this can be a big success and have more money from advertisers if the tone was kept friendly and relevant. Good job to those who are trying to give out good advice either from some sort of law education or maybe from past experiences. Poop on those who jump to conclusions and put others down.
