Minimum wage - Commission


What is the name of your state (only U.S. law)? MA

For an inside sales position in MA, how long must commissions be below minimum wage before an employee is entitled to quit and collect unemployment benefits?

The problem is not quitting and getting UI. The real recourse is to file a wage claim with the state Attorney General's office (which serves as the Dept of Labor in MA). Have you done that?

I am the employer and want to know when an employee, who quit saying his commission was below minimum wage, is entitled to collect UI (which he has filled for). How long a period must commission be below minimum wage before he is entitled to collect?

Cash wage plus commissions can NEVER be below minimum wage for any given workweek. I have no idea how MA sees this for UI purposes.
