my former employer can't afford to pay me


What is the name of your state (only U.S. law)? NJ

My boss doesn't have enough money to pay me. The store I was manager at has been going under for a while, but the owner refused to close it. He finally did(he told me on a Wed. 3 weeks ago that the store was closed and that was it - no warning, just I was out of a job. I had to ASK for severence, and he said he would give me 1 week). My (former) boss is a Physiologist, and he was paying for the bookstore from the money he made there, but reciently the IRS declared him a hobbie because he wasn't making a profit. That was when he finally decided that it was time to close, although he has had trouble with the IRS for back taxes already. While working there I recieved payment 1-2 weeks late on at least 5 occations (in the 8 months that I worked there), and there were other occations he would pay me out of pocket until he had the money in the account for us to cash the check & pay him back. It's been 2 weeks and he can't pay me for the last week I worked much less severence. what can I do?

He is not required by law to pay you severance.

You can file a complaint for the unpaid wages with the state DOL, keeping in mind the old adage about blood and turnips.
