No Laws For Salaried Employees?What is the name of your state? NY My husband's scheduled pay is for a 60 hour work week base. The company he works for has refused to fill 2 undermanagement positions.. His work week has been no less than 85 hours a week for several months and 1 week 115 hours!! If he does not comply his is threatened with demotion. Is this legal ? Thanks for your time.What is the name of your state? |

| If he is an exempt employee, then there are no laws limiting the number of hours he can work, in most cases. He is paid for the job he does, regardless of how long it takes him to do it. If he feels he is not being compensated enough for the work he does, then he is free to seek other employment. |

| Both exempt and non-exempt employees can be required to work as many hours as are required by the employer in all states except ME and CA, where there are certain limits on a weekly (CA) or bi-weekly (ME) basis. The only difference is that a non-exempt employee must receive overtime, while an exempt employee's salary covers all hours worked (no matter how many or how few) so no additional compensation is needed. |
