What is the name of your state (only U.S. law)? FLORIDA

I need help. I am a work at home customer service rep for a legitimate online company. I have come to believe that the company is engaging in unethical and perhaps illegal practices. During certain times that high call volumn is anticipated, the company will post bonus offers to attract work at home agents to commit to working . The bonues range from 1- 5 dollars extra per hour. In order to earn the bonus, one must not only work during the designated hours but must also have what is called a schedule adherence rate of 90 percent. The schedule adherence is based on one being logged in and ready to work during the time one is scheduled to work. For example, if I sign up to work for 1 hour and am logged in available to take calls for the complete hour than my adherence would be 100 percent. Any time on Not Ready or logged out detracts from the adherence. Herein lies the problem. The bounues are vitrually unobtainable because the system mysteriously acts up on these days. The system will log you out and keep you from logging in for extended periods of time, or it will not allow you to log on when you are scheduled to work etc. The effect of these system issues is that ones schedule adherence is knocked below the 90 percent required for the bonus. I have seen this happen so many times that I see a pattern and have come to believe that the disabling of ones systems etc are being manipulated by the company. I think they lure people to sign up with the bonuses and then if the call volumn is below what they expected, they limit the number of agents who can log in or stay logged in. When the company does this however, they do not release you from the responsibility of covering the hours you committed for ,they merely instruct you to keep trying to log in no matter how long it takes. Keep you hanging just in case the call volumn picks up .The other day I had to keep trying to log on for 1.5 hours before getting logged in. I was paid only for 1/2 hour. That is their policy. They require us to keep trying to log on no matter how log it takes but will only pay us for 1/2 hours. I can not believe that this kind of worker exploitation is legal. If I could find another job I would quit. It is so shady to dangle bonuses just to get people to sign up to work, and then if too many do, manipulate the systems so that one can not obtain the schedule adherence needed to get the advertised hourly bonuses. Where can I report this company and get the goverment to investigate their practice. Help

If you haven't been paid for all hours worked, you can file a claim for unpaid wages with the federal Dept. of Labor or a civil suit (or small claims action) in the Florida courts.

The federal DOL would question the employer as to if they could prove that you did NOT work the hours you claim, computer problems not withstanding. The courts will not "investigate" at all; since you would be the plaintiff, the burden of proof would be on you, not the employer. Keep your own records, on paper if you decide to take further action.

Not necessarily. Lots of different types of businesses employ remote CSRs, and they don't have to be involved in the sex trade to engage in illegal and/or unethical activities. Think Wal-Mart.

Whether it is or not is pretty irrelevant. Phone sex is a legit/legal business and they have to adhere to all the same laws.

Thanks for the advice Pattytx. The posts from the others were so childish and have no place here. No I do not work for an online sex company. Interesting thats the first thing that would pop in your mind. You are probably a purveyor of online porn sites no doubt. My company provides customer service support for Fortune 500 companies thank you very much!!

And thank you very much for this rude comment about my "childish" post. If you want any more advice, you sure as heck aren't getting it from me.

pattytx's advice was very good and accurate and I cannot see why you'd respond with such sarcasm. You probably won't be getting any more advice from her either.

And BTW, it was swalsh411 and no one else who thought you might be working for a phone sex company. If you have issues with this, take them up with him.
