Overtime issues


What is the name of your state (only U.S. law)?
NY
Myself along with a few colleges of mine were just informed that we could no longer work our night job at the school we are employed at because they would have to pay us overtime. We are secretaries during the day and then were hired to work at night school program as secretaries. They also told us that they do not have to pay us any overtime from the previous years. We talked to the labor department and they do have to pay us back overtime but the statute of limitations is only 2 years with the DOL. My questions is, many of us have worked our day job and continued to work at the alternative program for 5-10 years, are we entitled to that back overtime? 2 years just doesn't seem right.

The law will only go back two years, three years if the violation was considered "willful".

Overtime issues


If we retained an attorney or took this to our union would we be able to fight this?
Most of us are concerned that they are going to give us the two years back overtime pay and make us sign off on the overtime issue. The people who have 5-10 years vested in this issue feel that we are entitled to this money and that the district knew we should have been paid overtime all along.

If we retained an attorney or took this to our union would we be able to fight this? Fight the law? No. The law is the law - if you want to change the law, write your Congressman and Senator. Your union/an attorney don't make the law - the legislative branch of the State and federal goverment do.
