Pay Issues - Construction Company


What is the name of your state (only U.S. law)? Indiana

I have a couple of different issues.

1). I was terminated a few weeks ago and the owner of the company refuses to pay me the weeks vacation I earned. Can he refuse to pay me for it even though it says in the employee handbook that they will pay upon termination?

2) When ever an employee drove his/her vehicle for business purpose and they left from home or were going home from a work related place we had to deduct 30 miles (each way) from the overall total mileage before figuring the amount of reimbursement. Can they make us deduct miles from our trip?

3) I was a project manager in a commercial construction company. I was paid a salary and not paid overtime. If I wanted to file a claim against the employer for back wages (and I qualify) who would I contact?

1.) The state of Indiana has taken the position, more or less, that vacation time is due on termination unless there is a policy stating that it won't be. That's a simplification of Indiana's slightly-more-confusing-than-most-states' stance but that's pretty much what it boils down to. So if you have a company policy stating that it will be paid at termination you've got a pretty good case for payment. File a complaint with the IN DOL.

2.) In 48 out of 50 states, including Indiana, they are not required to pay mileage at all, so yes, they can deduct miles from your trip unless you have a legally binding contract or CBA that specifically says otherwise.

3.) As above, the IN DOL.
