Position change, but raised deniedWhat is the name of your state (only U.S. law)? VA Hello, I was working the Night Shift at Kmart. Upon being hired I was told if I perform well for 90 days I will receive a $1 per hour hiring bonus. You could not have a day off within the 90 days. 90 days came and went I received the $1 bonus. About 1 year later I was promoted to AM lead. Our shift was changed from overnight 10pm-6am to 4am to 12PM. I was given the alarm codes, and the keys to the store. My responsibility increased to handling money, signing for packages, invoices etc... daily. I was promised a 50 cent raise for opening and a 50 cent raise for closing. A few weeks later Corporate denied my raise saying I already received my $1 raise. They said when my shift changed to 4Am that my $1 should have been taken away for night differential. I countered by saying I never received night differential just a bonus for attendance. I asked since when is night differential earned, you should get it from day one. The store manager agreed and so did the district manager. Both managers said their hands are tied and there is nothing they can do. So now I am doing a job that they refuse to pay me for. I have called every HR resource person in the corporation and they all tell me I should have gotten it. But when it comes to actually implementing it the managers tell me the "you should have got it" is too vague. Everyone else on the night shift who had received a $1 bonus and went to 4am shift did not have their $1 taken away. My question is what is my recourse here? What is the name of your state (only U.S. law)? |

You should have quit when they backed out on your promised raise.

| What about the various meetings between district managers. I had to do the job responsibilities while they were "trying" to find out about my raise. |

Unless you were paid less than minimum you have no claim. Unless you were told you would be paid something and had your pay retroactively cut - you have no claim Them figuring out what you would (future tense) be paid and then not giving you a raise is legal. You are willing to work overnight, have cash ops experience, and closing responsibility history... you have opportunities for better work than K Mart Even in this economy.
