PTO payout upon separation - employer changed policy


What is the name of your state (only U.S. law)? Nevada

I understand that in Nevada, PTO is not required to be paid out upon separation. However, my employer had a written policy stating that the employee will be eligible for this payout. I was working at the company for 4 years, and on 1/1/09, the policy was supposedly changed.

At the time, we were emailed a document to print out and sign. The document was 2 pages, and the signature is only on the second page. I have the original email from these changes, and on the first page, it still states "Unused PTO that has been accrued will be paid out upon separation from the Company".

When I was quitting this month, I was told there was no payout, and I was shown a copy of the document, which says "Unused PTO that has been accrued will NOT be paid out upon separation from the Company". My signature is not on this page, however. I have reasonable suspicion to believe that the page was simply reprinted with the new wording, and they only kept the original second page which has my signature on it.

Are there any recourse I can take? Either to get my PTO paid out, or against the company since I have supporting documentation to think the document was altered?

Does anyone have any input on this at all? Any help would be greatly appreciated.

File a claim with the state Labor Commissioner's office. Maybe it works, maybe it doesn't.
