Retroactive raise compensation


What is the name of your state (only U.S. law)? Texas

We recently were told by our employer that we would be getting a 2% raise retroactive to July 2009 until the current pay period. Most of us assumed that the raise would be applied not just to the straight 40 hours, but for hours worked as overtime. Is it legal to just pay us a 2% raise only on the 40 hours, and exclude the overtime that had been worked during the time frame presented?

Since no law requires them to provide any retro pay at all, they can certainly decide whatever terms they like to apply to this "bonus".

The ONLY reason I can think of that it would matter is if the raise was required by law to meet minimum wage. Other than that, seeing as how the law does not require you receive a raise at all, let alone that it be made retroactive, the employer can decide which hours to apply the raise to and which hours not to apply the raise to.

Start making a stink about this and you may find yourself with no retroactive pay at all.
