What is the name of your state (only U.S. law)?

In NJ, if a non-exempt employee works mostly Monday through Friday, with an occasional Saturday on a rotational basis, can we grant the employee a day off during the week of the Saturday, or do we have to offer them the option of overtime pay?

Yes, you are free to alter an employee's work schedule so he or she only works 40 hours a week.

As it appears you already know, you can't do this outside of your regular payroll week though - e.g. offer a "compensatory day off" in week two to avoid paying overtime for the Saturday the previous week. In other words, if your payroll week is Sunday through Saturday (as many are), you have to alter the work schedule IN THAT WEEK in order to avoid paying OT.
