I am employed by a construction company in the state of Virginia. I am foreman who is paid a salary base pay, 40 hours per week with no over time. The company shut down for Christmas, from Wednesday Dec. 24, 2014 to Jan 5, 2015. Although we were asked to work Dec 30 and 31 which was 10 hours each day. Our pay was cut the remaining days not worked or force to take vacation time. Is this legal not being paid for the full week? Also is it legal to be forced to take our vacation time over Christmas?

An exempt employee must be paid for the full week if they work any part of the week, with a few exceptions that don't apply here. However, there is no restriction from being made to use PTO for some of this time. A complaint can only be made if you actually received less than your full salary for a week which you worked any hours.
