I am the office manager of a small company in the North Texas area. We currently have a small sales team of three employees.
In the employees contract we state that the each individual sales team individual can draw against
commission: $xx per month with a totaled cap amount. These sales individuals are base + commission.
My question centers around an employee leaving, voluntarily or involuntarily.
How can we enforce repayment of draw if the employee has not made any commission at time of termination?
