What is the name of your state (only U.S. law)? WI

One of our inside sales reps received commission on a sale that was partially refunded 45 days later. Is it legal to require them to pay back the amount that they made off the refunded amount? It the sales manager who approved the refund, not the rep. (Not sure of that makes a difference)

The terms of the sale states there are no refunds, but we made an exception for this unhappy customer.
There is nothing outlined in the rep's commission agreement.

If there is nothing in the sales rep's agreement, then legally you can't touch the commission he has already been paid.
