shall I sue the company for unpaid wages?


What is the name of your state? New York


i worked at a company as intern with a stipend, and they didn't pay me until I asked for after 1 month. and the boss said it will be on regular basis later. but the after 6 weeks I didn't receive anything. And I asked at 10th week, they said they would get it ready at Friday, and until next Monday it was still not ready, and I talked to another boss(her husband), he said they would mail me the pay check, and I quit. and this was last Monday. I called them again on last Friday, they told me will mail it this Monday. and I didn't receive it at Tuesday, so I called them again, they told me because the boss was sick so they didn't mail it yesterday. They are going to mail it today.

I called the NYS labor dept, and told them about this. the officer there told me if I didn't receive school credit for internship, it is not considered as an internship, I should be paid at least min wage. and He ask me to come to their office to file a claim.

Now, I am not sure what the claim process will be. how long is it going to take. Does it hurt for me to against the company?

I'm not sure, but they could have answered your questions over the phone. No, you don't sue for this, you file a claim.
