What is the name of your state? - New Jersey

I was not able to file Federal and State tax returns on time because of my employer's negligence only (IN SIMPLE WORDS - DID NOT GET W2 FORM IN TIME). I have been suffering a lot because of them.

Now I want to file some kind of complaint against them so government agency such as IRS should take action against them or at least warn them.

Kindly let me know where I can file complaint against them?

You COULD have complained on 2/1 when you did not have your W2. It's a bit late now.

2-15, actually, is the first date that the IRS will accept a complaint of a W-2 non-received. They recognize that one put in the mail on 1-31, which is legal, may not necessarily arrive by 2-1.

You can complain to the IRS now, but the first question they are going to ask is what actions you took between 2-15 and 4-15 to get your W-2s and why this is the first time they are hearing about it. You had two full months to complain to them - why didn't you?

You can also file an estimated return prior to April 15 using paystubs to determine wages and taxes. The IRS will correct any errors based on the information submitted by your employer and send a refund if you are due one. If you will owe taxes, make the the payment with the estimated return.

Thank you guys for the reply.

First of all, I did not that there is any timeline for complaint. Second, I had been requesting them regularly for W2 form. They and I were not sure when I would be getting it in my hand.

They did send W2 form THREE times, but all had some mistakes.

When I received W2 form first time (January end) and I contacted them, they literally declined that there can be any error in it. I was asked to see Tax specialist before making any comment.

After visiting Tax specialist, I was somehow managed to convince them. Also because of incorrect W2 form I have visited Tax specialist three times so far.

PLEASE LET ME KNOW HOW I CAN COMPLAINT AGAINST THEM NOW?

If you are bound and determined to file a complaint with someone, make it to the IRS. Whether or not they will accept a claim, since you had options available that you did not take, is anyone's guess. It's neither your employer's nor the IRS's fault that you "didn't know" about the timeline for complaints. It's certainly not your employer's fault that you failed to file an estimated return.

Sir, I still believe that its my employer's fault. Because I had been requesting them regularly and they kept me thinking that I would get it soon every day. Thats why I hesitated to file estimated return.

The real story is that I was told I would get W2 form on (at least) 04/15 which was last day and them at 4.00 PM, I came to know that I am not going to get it. That day I was sure I would get it and I even had taken appointment with Tax professional.

Please imagine, I am supposed to file extension by 04/15 and time was before 5.00 PM. But they told me that I am not going to get it today ( 04/15) at 4.00 PM. Please understand how much stress I had that time.

As you said about IRS, how can I file complaint? The form f4868.pdf seems to be for individuals. Kindly let me know.

Since there is a repeated attempt to supply you with your W-2, there is no "intentional disregard" for the law. Because of this, I believe the maximum penalty is $50.

Knock yourself out. Be sure to find another job first and be very sure you don't ever need a good recommendation from the employer in the future.

Thats enough for them. Even just a warning for them is good because I hope that would not happen in again with any other employee.

I meant the form f4868.pdf seems to be for complainting about indivisual. I was not sure about that form and a right way thats' why I have been seeking help here.

The form you mention is an extension to file your income taxes. if you owe, it still was due by 04/15/08.
