threatened to be sued!


What is the name of your state? Florida
ok heres the situation my husband was working for this company and he was on a draw commission salary. he is $10000.00 in the hole well today he quit his job because he was going to get fired anyway at the end of the month for not making a deal.. so it was either quit now and find another job or get fired in 2 weeks and not get paid so he quit. well his boss called me and was yelling at me and basically said he was going to draw up a lawsuit. however 2 prior people who worked there one owed more then $10000.00 ( a female) and the other owed a little less then $5000.00 they never got threatened or a law suit brought up on them. Can his employer sue him and not the other people?? or does he have to repay the money? please help we have like no money just had a baby 2 months ago and are living at my parents house. Thanks so much!

That is very confusing but if I'm understanding correctly, your husband's "draw against commission" compensation arrangement resulted in your husband being advanced $10,000 which he had not yet made up in sales at the time he quit. Since we have no idea at all what sort of agreements your husband may have signed regarding his compensation plan when he was hired, nobody here can possibly tell you whether your husband can be successfully sued for the money the employer is due. All we can tell you is that the employer is free to file a lawsuit against your husband if they wish to do so.

he did sign a contract however no where in the contract states he was liable for the money. Also when he was first employed the manager (who is the one making the threats) told not only him but everyone else that was hired there that they did not have to worry about the money owed if they got fired or quit. do i have anything to worry about?

We don't know if your husband will have to repay the money. However, the employer can sue your husband for repayment & not sue the other people.
