Unpaid "On Call" or "Stand By" time

The following occurs in California:
Situation: Employer(U.S. Government Contractor) requires of an hourly, non-exempt employee the following:
  • Reside and remain when off duty, within a one hour commute to work location.
  • Carry and monitor company provided pager and mobile phone, subject to recall to work at all times 24 hours, daily. 7 days a week. Weekends and holidays included.
  • No compensation is paid for "On Call" time, (while U.S. Government Employee peers receive differential pay for "On Call" time).
Question: Should the employee be paid for their "On Call" time?
