Wage deferral (Indiana)What is the name of your state (only U.S. law)? Indiana Our company has fallen upon very hard times being an automotive supplier. They have just invoked a "Permanent Deferral" of our pay for an additional two weeks. Initially, all employees were under a single week, which I believe is fairly standard. You receive your pay for the actual hours that you worked the prior calender week. Now they have pushed us out to three weeks, which results in the employees receiving no pay for this period. Actually, the company is alternating weeks to minimize the effect on the employees. The three week deferred wages are then only paid upon separation. Is this change legal? |

| So, after this, are they still going to pay you on a weekly basis? My resource for how long is allowed between the end of the pay period and payday is at work and I'm home sick today. If nobody gets that info for you, I'll post it tomorrow.

| Patty Yes, after this alternating six week period to accrue our three weeks, we will then supposedly resort back to our normal weekly pay. I guess you are correct in the question being how long an employer is able to delay (or defer) paying an employees wage past the end of their pay period in Indiana. I hope you feel better and I appreciate your help. |

| In Indiana, you must be paid no later than 10 days following the end of the pay period. Ind. Code Ann. §§22-2-5-1, 22-2-5-1.1, 22-2-5-2, 22-2-5-3
