My mother-in-law is executor and heir of her cousin's estate.He died in Pennsylvania and we have discovered a safety deposit box in New York City. She is in poor health and would have extreme difficulty making the trip to NYC to access the contents. Is there a mechanism for her to (appoint, assign, etc) someone else (her daughter, who was named as the next executrix if her mother could not handle things) to go to NYC and access the contents. My mother-in-law refuses to relinquish the executrix role.

DEAR DJACKSON:

The executrix should discuss this situation with the bank in New York that possesses the safety deposit box (she could speak with the people in the Safety Deposit Box department, or with an executive official at the bank), since they have probably encountered that same situation before, and they probably already have specific rules about what can be done.

Maybe they would ask that the daughter bring a letter authorizing the executrix's permission to access the contents, or maybe they need a court order from the probate judge, or maybe they would allow a "LIMITED POWER OF ATTORNEY" form (which is usually available at any office supply store in the legal forms section, or available from any attorney) that would be signed by the executrix (with a notarized signature) to allow the daughter to act in her behalf on just that one occasion of the safety deposit box opening.

Have contacted the bank reps and they will not accept anyone except the named executrix unless there is a court order. thanks
