What is the name of your state (only U.S. law)? North Carolina

Our oldest son turns 18 on Jan 28th, 2017. We would like him to become the legal guardian of our younger son. How do we ensure this happens if we die before Jan 28th?

We realize this is an odd question considering the short time until Jan 28th. However, we are attending the inauguration and want to have a plan in place if something catastrophic happens.

If you made your older child the legal guardian of your younger child, then your older child would have more authority than you do regarding decision making for your younger child. I think what you really mean is that you want to make your son the standby guardian of your younger son. A standby guardian is someone that takes over if you are deceased or incapacitated.

I would recommend a consult with a local attorney, although time appears to be very short.
