The will leaves all to my wife --- can I write an amendment to leave assets equal to the unified credit to a trust for her benefit with out spelling out the details of the trust --- in other words could she write the terms of the trust after my death or must I have a trust agreement drawn at the time I amend the will? Thanks for any guidance, Niles

If your combined estates are over $700,000 you'd be a fool to try it yourself as anything over that is taxed at 37% plus.

And amending a Will is tricky - it usually pays to start from scratch and redo the Wills and get them properly executed and witnessed.
