I live in North Carolina and have 2 children from my first marriage. I would like to leave my children 25% of my IRA and my wife 75%.

This IRA was a rollover from my 401K. I believe that with a 401K, you need your spouse to sign an approval for the beneficiary to be someone other than your spouse. Does this also hold true for an IRA? Since my wife will get 75% anyway is her approval needed?

DEAR MARTY:

No, your wife's approval is NOT needed for the IRA, but you must fill out a beneficiary form that specifies your wishes.
The company that is handling your IRA can furnish the form if you contact them.
